Can Foreigners Own Land in Boquete, Panama?

How property rights work for foreign buyers in Panama and Boquete: what you can own, the coastal and border restrictions, and how to buy safely.

The short answer is yes: in most of Panama, foreigners have the same property rights as Panamanian citizens. You can buy titled land, register it in your own name, and sell it later — no local partner required.

Boquete sits inland, in the Chiriquí highlands, which is precisely why it is one of the simplest places in the country for a foreign buyer to purchase property. The complications, where they exist, are geographic.

The Main Restriction: Coastal and Border Land

Panamanian law restricts foreign ownership of land located within a defined distance of coastlines, national borders and islands. In those areas, ownership by foreigners can be limited or require a different legal structure.

This matters if your retirement plan includes a beach house on the Pacific or a farm near the Costa Rican border. It generally does not affect typical Boquete purchases — but it must be checked before you sign anything, not after.

Titled Land vs. Possession Rights

Not all land in Panama has a registered title. Some rural properties are held under derecho posesorio (possession rights), which is a very different — and weaker — form of ownership.

A good rule for foreign buyers: buy titled land, and verify the title before you fall in love with the view. We run a title search at the Public Registry to confirm who really owns the property and whether it carries liens, mortgages or boundary disputes.

How to Buy Safely

A Boquete purchase usually involves these steps:

  1. Due diligence and title search.
  2. A written purchase and sale agreement with clear conditions.
  3. Payment through a properly structured route — never cash to a stranger.
  4. Closing by escritura pública before a notary.
  5. Registration of the transfer at the Public Registry.

Each step protects you. Skipping one is how people end up owning a property that someone else also claims to own.

Buying Inside a Development

Many Boquete properties sit in gated or master-planned communities under Panama’s Horizontal Property (PH) regime. That adds a second layer of rules — HOA regulations, maintenance fees and building restrictions — that we review alongside the title.

Before You Commit

Foreign buyers in Panama are well protected, provided they do the diligence. If you are looking at property in Boquete, have the title and the contract reviewed first. The consultation is free, and it is far cheaper than a mistake.
